My situation is similar too.
The employer is not ready to file the 485, thinking that I may leave the company after 6 months.
I have the I-140 receipt notice , but no approval notice.
There is no way he is going to issue a employment letter , still debating my options.

Here is my update:
EB2 - India
PD - Sep/2006
I 140 approved - Dec 2006
I 485 Date received July 2nd 2007
RD - checks were cashed (date - July 30, 2007)
FP - Got a mail from USCIS regarding finger printing (scheduled - August 29,2007)
So far no receipt by mail, application is at Nebraska.

Two things
1. Consultant can be part of job title and/or duties. Key thing is that job must be permanent and full-time.
2. PERM can only be filed for job that are permanent and full time.

I have talked to few people who do self employment. This is what they have to say.
"As long as the job duties are same or similar, it is fine",
"You must be a W2 employee of your firm"
"The key is constant business and income - which can be proved via paystubs and/or contracts - in case it is requested for"
I am also trying to do some research on this.
A lot of people do go for self employment so no need to be scared as long as the employment is legitimate.

maybe there are not enough EB3- I cases in the queue ;) ..well one of my friends did get his GC during last fiasco ..eb3 - I, pd 2003. ofcourse there is no unity ..it is every man for himself (And hence save as much as you can while you enjoy life)..and hence don't worry too much ..GC will come when it has to (my friend told me that once ..and I found those words comforting) ...see few of the threads nearby ..people are content talking about dots (I guess since they know nothing will ever happen due to our actions :-) ..and I sort of agree).

I am really surprised that you guys are contemplating on going against your employer for a employment letter and filing your GC. I mean, how hard is it for you guys to agree to the terms of your employer that you will work till you get your GC and upto 6 months beyond that..
If you guys came before 2001-2002 and seen how the situation was for green card filers you will now what I am talking about..
1. There was no concurrent filing of I-140/485
2. There was no premium processing for Labor
3. There was no premium processing for I-140
4. There was no AC-21, so there is no way of switching jobs..
Still it used to take 4-5 years to get a GC.
And you guys are complaining about your employer because you worked for 1-2 years and you want to quit as soon as you get EAD..
Just imagine what would have happened if the dates were not CURRENT.. How many more years you would have worked, cursing USCIS
Your greed will ruin you in future, just like you are cursing your employer's greed..
Also, before you curse your employer, it was you who joined the company and you had many months to find out what kind of employer you have and it quit the company long time back.. You could have switched to different company long time back..

Your post is a classic example to show how everybody will not understand the other person the same way.
If a person isn't contributing money, isn't participating in state chapters, isn't going to any rally and his/her sole contribution is 'brilliant ideas' that get posted on the forums... only use he/she can be put to is inter-breeding donkeys and horses, like you said!

I called there office but no clue what SKIL bill is about (Washington DC).
Can any one explain the source of this bill.
First and foremost, DO NOT CONTACT Sen. Cornyn's office.
We are privy to some information and we were told that Sen. Cornyn might introduce this to the senate today. When we say might, it means that there is a good chance he may not do so too!
And introducing just means that he will get a number assigned to it. It will NOT be debated today. The debate timeframe is decided by the majority and minority leaders Frist and Reid respectively.
We just wanted to share with you what we learned. When we learn more, we will let you guys know. For right now, all we know is in the first post.
And FYI, there are some decent provisions in this bill especially related to STEM. Also presents a solution to retrogression wherein Adjustment of Status would be possible in spite of no visa being available.

I dont have a problem signing 1 yr agreement because my 140 will take at least another 8 months ( Feb 08) and by the time next years budget opens up for good new Jobs its already Mar 08.
But my concern is if my employer wants me to hang on with them till 485 is approved and then 1 more year

Every contract must have well defined terms. Since date for I-485 approval is not known, such contracts are difficult to stand in court of law. However, if it says "the employee must work for 2 years or 6-months after I-485 approval date (whichever is earlier) otherwise he/she will pay all GC related expenses" then the contract is more likely to be enforceable.
All depends on the wordings of the contract.
Please consult a good lawyer BEFORE signing any contract.
