Here is my case. My lawyer sent the papers on July 5th. and the package were received at NSC by F HEINAUER. We're a family of 4.
I have a LUD on the approved I140 on 07/28/07 (TX).

I guess it would have to be a pretty big and wild rally to have the police getting involved. :p
But Chandu raises an excellent point. There is much more to a rally than just turning up. Some one from core can probably help with detailed instructions.. these are just my thoughts.. feel free to add/correct.. (PS: I have zero experience in rallies, by the way)
First, I suppose checking with the local authorities and informing them of your plans, expected turnout, location, duration etc before anything else is a good idea. Bad idea to have have an unexpected crowd turn up randomly in a public place.
Organize placards, banners, podium, hand outs etc. Dont forget first aid kits, water.
Figure out who is going to be the spokesperson for the rally. Would be pretty silly if a reporter does come there and no one knows how to articulate well.
The spokesperson should check with core regarding message etc. This is important.
If there is critical mass for the rally, and the authorities are informed etc, then contact the local news and inform them as well..

It is generally poor practice to go for gung-ho activism in a situation where you are unclear about the law (e.g., non compete) and unable to get good counsel (e.g. immigration and business law attorneys).
Just keep this in mind. Long term, your peace of mind is worth more than $4K ... just think if there are other ways in which you could have handled this.... in case such event pop up again.
If I were you, I would have a civil conversation with that company. Tell them that economics took over empathy, that you wish to be in a position where you have less financial loss and would appreciate an amicable parting of ways.
It's a small world out there. Dont pi*s on anyone, lest it come back to wet your backside!
Sabre rattling might get you out of this one, but the world still remains a small place!

Why would the dependent not file AOS at all ? Are you refering to CP ?
My good faith best understanding is FB2 is not far behind. please refer VB.
There may be a chance that Eb2 india will touch 2008 in a year. and F2b will be at 2006. How dependet can file 485 as if they counted against F2A their date is not current.

I have observed in the past whenever an EB3 member brings a conversation of spillover to be used for older priority dates or for EB3 etc, the member has been marked with reds from EB2 members to express their dissatisfaction. Kondur, note that the infighting between EB3 and EB2 has been happening both ways for a very long time and USCIS has been successful in creating this divide.
Your thought process of change by lawmakers are noted. BTW the traction of EB2 members will always be lost every year around this time as EB2 candidates will end up bulletin watching till it affects that category.
This is a bitter truth we all have to swallow that between Jul - Sept every year there will be negligible EB2 members participating in IV's action items and on the other hand EB3 members feel that injustice has been dealt to them and end up feeling resigned.
At least this member sanhari is trying for something. If you all did not observe, he/she was voicing the same thoughts in the EB2-EB3 predictions thread, he was asked to not hijack that thread and was asked to create an own thread which was respectfully followed.
If we try to go offensive on members who are at least trying to do something than sitting idle, it is a shame. We need more EB2 members also who end up getting their green cards to comeback and support for this fight against EB3 members by contacting lawmakers to get some mass than talking about quarterly spillover etc. Because if the EB3 problems are addressed and we find a solution to resolve this backlog we never have to worry about spillovers or waitimes. But that rarely happens. Everybody wants a solution what works them or to be more precise, exactly till their priority date in their country and category.
I hope EB3 members start at least join this thread to show the support if not for this idea at least for future action items from IV Core. EB3 members have been passive whereas EB2 are active in predictions and bulletin watching. It really is disheartening looking at the participation or lack thereof in any EB3 threads. Firstly, no one can shut down thoughts. They are inside your head. What I am saying is that match your thoughts with your actions, not just expression of thoughts. If you want to express your ideas and thoughts, do it in a way that its heard by people that matter. Your ideas and thoughts heard by other people like you is meaningless. If you can match ACTIONS to propogate your thoughts, by hauling your ass to Washington DC, spending some $$ out of pocket on travel to DC and meeting with a few of the 535 offices, then it matters. Otherwise your idea is not worth 2 cents sitting on forums read by people who are not legislators.
Secondly, YOU THINK that asking USCIS to follow the rules is easier than changing rules (thru legislation). Which also means that they dont have to worry about making people angry.

Is Immigration Voice an organization that can raise 100,000 a month each month? NO. Not right now. Right now, people are busy checking their mailboxes for EAD cards. So until that happens, feel free to express your thoughts and opinions and brilliant ideas and happy forum discussion. If that's what makes you all happy and content.

I think IV should make it mandatory for $25/monthly charge for all the folks.
At least we can get rid of the dual-nature of 'helping you, only a little bit' sort of tendency.

i.e. assume my PD is X. If X is current in FB category but not in EB category - both the primary and the dependent should still be able to file I485. Same happens if X is current in EB and not in FB.
In this scenario - if the family based category is retrogressed:
Option 1: Spouce can wait the retrogression out in AP/EAD.
Option 2: Primary can become a citizen in 5 years and then "upgrade" the I485 to a new FB category with no retrogression.
Without this joint filing if either category is current - it can cause nightmares for the dependent if the primary gets a GC and the dependent loses H4/L2.

My family do not have SSA? I need to apply for them as well.
It won't take more than 1 hr to get all those. A simple form to be filled out (for a new SSN) and I think SS5 form (please google) for those updating SSN. It's very simple procedure. SSA will need proper ID/ and GC to verify your current status. Card should arrive in 2 weeks...
